The cost of Marsy's Law

SIOUX FALLS, S.D. (KELO AM) - Marsy's Law hit Minnehaha County square in the pocketbook today when the commission considered hiring four, victim-witness, assistant positions to the State's Attorney's Office.

Aaron McGowan says his office must be constitutionally compliant.

McGowan says the task of notifying all victims of court dates has increased his office's services across the board for all the new crimes included in Marsy's Law.  He says his office has seen a watering down of current services provided.

McGowan says the office gets arrest reports at 7 a.m.  Criminal complaints must be filed by 10:30 in the morning and those case go on the court docket beginning at 1:30 in the afternoon.

He says those victims have to be notified and that can't be done by mail.  So, McGowan says, "we have a lot of responsibilities every morning to provide those victims with a notice of the bond hearings on day one."  

The commission delayed a decision until the cost is determined.
