SIOUX FALLS, S.D. (KELO.com) -- The young woman buried for hours in the rubble of the downtown building collapse, and her parents, have filed suit against Legacy Development and Hultgren Construction, among others.
The suit alleges that Legacy Development, Hultgren Construction, and others, were negligent and asked for unspecified damages in a jury trial.
Mike Fodness recently spoke in front of the Sioux Falls City Council saying, "That morning our home and our lives came crashing down. Our daughter Emily was buried alive beneath tons of rubble. We thought our beautiful girl was dead."
Emily was sleeping in the Fodness residence above when the building collapsed around her back in December 2016.
The Fodness suit follows closely on the heels of the lawsuit filed by the family of Ethan McMahan, the construction worker killed in the collapse.
