SIOUX FALLS, S.D. (KELO.com) -- The interim Sioux Falls City Attorney has told the City Council and the Mayor not to talk to the media regarding the federal criminal investigation of death of construction worker Ethan McMahon last December.
Karen Leonard wrote via email yesterday:
"I understand the media may be contacting you regarding the building collapse and a potential or pending criminal investigation."
Continuing.
"I would advise if any of you are contacted by the media, it would be best if you had no comment on the potential or pending investigation of Hultgren Construction. It is my advice no disparaging comments should be made as no party has been found guilty."
City Councilor Theresa Stehly told KELO.com News that she is displeased with being told by Leonard not to comment. Stehly says there's been enough secrecy surrounding the building collapse, the parking ramp/hotel project, and Hultgren's participation in the ramp project through Legacy Developments.

"I think it was sent out because the light is shining on the whole aspect," Stehly said.
Yesterday, the Argus Leader reported the federal criminal investigation. The Argus report did not state directly that Hultgren Construction was the U.S. Attorney's target. Hultgren Construction has been fined by the Occupational and Safety Administration. Hultrgen has appealed the fines.
Earlier this month, the City said it would not comment on the commemoration of the Copper Lounge collapse that occurred Dec. 2, 2016.
