Commissioners waive drainage fine

SIOUX FALLS, S.D. (KELO AM) - Its not the amount of the fine that landowner Paul Weiland was contesting.

Its that Minnehaha County planners told him he didn't need to get a permit to straighten a channel of Silver Creek between Baltic and Dell Rapids.

Weiland says he got a permit to tile the area and he refuses to pay a $500 fine for drainage work.

He says he was given bad advise from county planners who he claims told him that he didn't need a permit for work on a "named creek."

Kevin Hoekman with county planning says he issued Weiland a permit for the drain tile.

Hoekman added that from his experience in telling people what's needed and what's not needed, "there isn't any drain tile or drainage digging that can be done without a permit."

The commission waived the fine saying everyone was confused.
