The group opposing Amendment S on victims' rights--the so-called Marsy's Law--says it is not a law and not needed.
Attorney Ryan Kolbeck says since Amendment S is a state constitutional amendment, it will be difficult to change or remove in the future.
Further, he says South Dakota already gives more rights to victims than most states that have adopted the measure, including Texas. Kolbeck says prosecutors are concerned that it will take away the attention that victims of violent crime currently receive, as all victims--even big companies like Walmart--could claim rights.
He also noted county property taxes could increase to fund the notification mandates.
