SIOUX FALLS, S.D. (KELO AM) - Convicted murderer Rodney Berget told a Sioux Falls judge this morning that this is last time he wants to appear in court as he dropped his execution appeal.
The judge has yet to rule on the case.
Berget sent a letter to the judge withdrawing his appeal, but his attorneys said they oppose their client's wishes.
South Dakota Attorney General Marty Jackley said there's no evidence that Berget isn't capable of making the decision.
Berget and Eric Robert killed penitentiary guard Ronald Johnson during an attempted prison escape in 2011. Robert was executed a year later.
