PIERRE, S.D. (KELO AM) Former U.S. Senate Candidate Annette Bosworth wins one and loses one in the South Dakota State Supreme Court.
The Court has overturned her perjury convictions, but has upheld her convictions for filing false documents.
All the charges stem from the signature petitions used to get Bosworth on the ballot for the Republican Primary in 2014. The primary was won by Mike Rounds, who went on to win the general election.
In May 2015, Bosworth was convicted on 12 felony election law violations. She received a suspended sentence with three years probation.
The state's high court has vacated the six counts of perjury, essentially ruling that Bosworth's actions did not constitute willfully telling an untruth under oath.
But the six counts of filing false documents will stand - the court ruling that voters did not sign the petitions in her presence, thus the petitions contained untrue statements.
State Attorney General Marty Jackley says that the court's decision upholds the integrity of South Dakota's institutions and election system.
"The decision affirms the hard work and deliberations of our citizen jurors in this case,” says Jackley.
