SIOUX FALLS, S.D. (KELO AM) A bill capping out-of-state contributions to ballot question committees to no more than 75% of all monies won approval in the House State Affairs Committee today.
Republican Representative David Lust of Rapid City says if the measure becomes law it will surely be challenged.
Lust says the bill will not pass Constitutional muster. He says legislators are saying to the citizens of South Dakota, by passing this bill, "you don't know how to sift through speech. You don't know what's good speech and bad speech. But we do."
Representative Mark Mickelson says the measure has been narrowly crafted.
Mickelson says the bill does not restrict out-of-state contributions to candidates. And the bill does not restrict their ability to contribute independently. "So if they still want to come in and screw around with things they can."
The bill earned a do pass recommendation.
