City attorney asks Councilors not to talk about safety at Falls Park

SIOUX FALLS, S.D. (KELO.com) -- The City's deputy city attorney has sent out emails to City Councilors advising them to not comment on pending litigation regarding Falls Park, but also not to discuss safety in general at the park.

Late this morning, deputy City attorney Karen Leonard sent an email that said Councilors should not comment to the media regarding Saturday's water rescue.

"You may receive calls from the media asking for a comment on the matter (Saturday's rescue)," Leonard wrote. "I want to remind you of the note I sent last week regarding the Zaiger potential lawsuit. I again advise you not to comment at this time."

Leonard then sent a followup email early this afternoon.

"The second issue is taking a look at safety as a whole at the Falls," Leonard said. "My advice to you regarding interviews with the media is to avoid being led into making any legal liability statements. It is the safest approach as those comments are sometimes are edited and can be used against the City or you could inadvertently make comments which could be deemed admissions of legal liability against the city."

The City Council will consider a $300,000 appropriation tomorrow to add another viewing area at Falls Park.
