SIOUX FALLS, S.D. (KELO.com) -- The mother of the little girl who drowned in the foamy river at Falls Park may sue the City of Sioux Falls.
Sioux Falls Attorney Brendan Johnson is representing Courtney Jayne of Audubon, Iowa.
Johnson tells KELO.com News that he is investigating a potential lawsuit, and has so informed the city in writing.
He's made several requests of the city, but would not specify what he's looking to get.
Deputy City Attorney Karen Leonard confirms that the city has received notice of a potential claim, but wants to point out that not all such notices result in a lawsuit.
Jayne related on her Facebook page after the drowning in March that she was helping the little girl's sister navigate the rocks, when in "less than 60 seconds" Maggie Jo Zaiger, 5, was gone.
"I've been that parent judging others, wondering how can these things happen. Guess what? They happen. In 2 seconds. Faster than any human can react." Jayne wrote on Facebook.
Ever since the drowning, there has been debate in Sioux Falls about the level of safety at Falls Park and whether or not more should be done. Just this week, City Councilor Theresa Stehly requested that city officials brief Council on park safety moving forward.
Johnson, with the Robins Kaplan Law Firm, is the former U.S. Attorney for South Dakota and son of former U.S. Senator Tim Johnson (D).
