SIOUX FALLS, S.D. (KELO AM) - A measure that allows liability against public entities that ban firearms on their property, and an individual is subsequently injured during a crime of violence, was defeated in the Senate Judiciary Committee today.
Senator Stace Nelson of Fulton accused lawmakers of their willingness to "blithely trample over South Dakotan's Constitutional rights."
Nelson went on to say that his question to those who protest so loudly is how many shootings have there been since 2013 in what he called magical gun free zones. He says we hurt our children and tell criminals and terrorists that there are no guns in schools.
Nelson says there have been 213 school shootings since 2013 and says those zones "are not magical" and "do not protect law-abiding people. They prevent law-abiding people from protecting themselves."
Senator Craig Kennedy of Yankton says the bill is too broad and has unintended consequences.
Kennedy says under the measure you could be prevented from bringing a handgun to a park, get runover by a truck and you could have a potential claim under Nelson's bill.
The measure was sent to the 41st day.
