SIOUX FALLS, SD (KELO-AM) A circuit judge has ruled that a controversial new house in the McKennan Park Historic District in Sioux Falls must be rebuilt smaller or relocated.
Judge John Pekas says the big house undetermines the entire historic district.
Last year, the next door neighbors sued the owners of the new home, claiming it cut out their sunlight and forced them to stop using their fireplace.
The home was built for Joseph and Sarah Sapienza. Pierce and Barbara McDowell filed suit. The new home is within seven feet of their home.
Considering the potential cost of making the new home smaller or actually moving it, the judge's decision may not be the last legal word in this real estate debate.
